Employer Accreditation for Hiring Migrants on the Accredited Employer Work Visa (AEWV)
To employ migrants under the Accredited Employer Work Visa (AEWV) program, employers must meet specific standard requirements and additional commitments. These requirements vary based on the level and type of accreditation, as well as the number of migrant workers being employed.

Types of Accreditation

Standard Accreditation

Standard Accreditation

This allows employers to hire up to 5 migrant workers on AEWVs at any given time.

High-Volume Accreditation

High-Volume Accreditation

Employers with high-volume accreditation can hire 6 or more migrant workers on AEWVs. This accreditation also applies to employers using triangular employment arrangements (e.g., labour hire companies).

Job Quota

For employers holding standard accreditation, a job quota of up to 5 positions applies. The job quota is utilized once a Job Check is approved. A quota space becomes available again if:
  • The migrant’s visa expires or is cancelled.
  • The migrant’s visa conditions are altered to allow work with another employer.
  • The job check expires or is cancelled without a visa being issued.
Employers requiring more than 5 migrant workers must upgrade to high-volume accreditation.

General Criteria for Accreditation Applications

Employers applying for any accreditation must meet the following criteria:
  • Hold a New Zealand Business Number (NZBN).
  • Operate as a genuine business, registered with the Inland Revenue Department (IRD).
  • Demonstrate financial stability by meeting at least one of the following:
    • Be profitable for the last 24 months (before depreciation and tax).
    • Have positive cash flow for the last 6 months.
    • Have sufficient capital or external funding.
    • Present a viable business plan to ensure ongoing financial health.
Note: Businesses operating for less than 12 months must provide evidence of financial stability. Employers must have a clean history of regulatory compliance, and key officeholders must declare this.

Employer Commitments

Employers must commit to several obligations throughout the accreditation period, including:
  • Notify Immigration New Zealand (INZ) within 10 working days if an AEWV holder leaves their employment.
  • Provide settlement support to migrant workers, including:
    • Information on IRD numbers, accommodation, transportation, cost of living, healthcare, and community support.
    • Access to online modules on employment rights.
  • Pay all recruitment costs, including advertising, agency fees, immigration fees for employers, job check applications, trade testing, and tools owned by the employer.
  • Do not charge migrant workers any illegal fees, such as job placement fees or unreasonable deductions.
  • Maintain records to ensure compliance with the above commitments.
These declarations must be part of the accreditation application, and employers will need to provide evidence during renewal.
Accreditation for Employers Placing Migrants with Third Parties

For employers who place migrant workers with third-party employers, such as labour hire companies, additional and more stringent requirements apply.

Job Check Process for Accredited Employers

Advertising Requirements

The job must be advertised on a general, national job listing website, such as Seek or TradeMe. You may also choose to advertise on more specialized platforms if they are more likely to attract qualified New Zealanders. Examples of such platforms include VetJobs, Engineering New Zealand, Farm Source Jobs, or ZEIL.

Ensure that you apply for the Job Check within 90 days of the job advertisement closing. The job listing must have already closed before you submit your application for the Job Check.

For jobs classified at ANZSCO skill levels 4 or 5, you may also be required to engage with Work and Income to confirm there are no suitable New Zealand candidates for the role.

Jobs Exempt from Advertising

Certain jobs are exempt from the advertising requirement before applying for a Job Check. These include jobs that:

  • Are listed on the Green List and meet the specified Green List criteria, or
  • Offer a wage of at least NZD $59.32 per hour (twice the February 2023 median wage).

Minimum Advertising Duration

The required duration for advertising depends on the skill level of the role:

  • ANZSCO skill level 1, 2, or 3: You must advertise the job for at least 14 days.
  • ANZSCO skill level 4 or 5: The job must be advertised for at least 21 days, and you will also need to show evidence of engaging with Work and Income about the vacancy.

Ensuring a Genuine Search for Suitable New Zealand Candidates

When advertising, it is essential to make genuine efforts to attract and recruit suitable New Zealand workers. For a candidate to be considered suitable and available, they must meet the following criteria:

  • Be a New Zealand citizen or hold a resident visa.
  • Be qualified for the role or able to undergo training on the job.
  • Reside close to the job location or be willing to relocate.
  • Have practical transportation options, such as access to a car or public transport.
  • Be available for full-time work during the required hours

Reporting in the Job Check Application

As part of your Job Check application, you will need to provide details about the recruitment process, including:

  • The total number of candidates who applied for the job.
  • The number of New Zealand citizens or resident visa holders who applied.
  • The number of New Zealand citizens or resident visa holders deemed suitable for the job.
  • The number of New Zealand citizens or resident visa holders who were hired.

For roles classified as ANZSCO skill level 4 or 5, you must explain why any New Zealand candidates who applied were deemed unsuitable or unavailable for the position.

If the information provided shows that there were suitable and available New Zealand candidates, your Job Check application may be declined.

Accredited Employer Work Visa (AEWV)

The Accredited Employer Work Visa allows you to live and work in New Zealand if you have a valid job offer from an accredited employer and meet the required skills and qualifications for the role.

Secure a position with an accredited employer who offers you a minimum of 30 hours of work per week.

Study:

You can study for up to 3 months within any 12-month period, or complete any study required as part of your employment.

Pathway to Residency:

If eligible, you can apply for a Straight to Residence Visa, Work to Residence Visa, Care Workforce Work to Residence Visa, or Transport Work to Residence Visa.

Skilled Migrant Points:

Use your skilled work experience in New Zealand to claim points towards the Skilled Migrant Category Resident Visa.

Visa Duration

Most holders of the AEWV can stay in New Zealand for up to 5 years. However, if your position is in an ANZSCO skill level 4 or 5 role or you are paid less than the median wage, your total stay may be shorter.

Visa Conditions:

  • Your visa ties you to the accredited employer who offered you the job for the duration of your visa. If your circumstances change, you must apply to vary your visa conditions or apply for a new visa or job change.
  • You may be able to support work visas for your partner and visitor or student visas for your dependent children.

  • No Recruitment Fees: New Zealand employers or their agents are prohibited from charging you fees for securing a job or asking you to cover any recruitment costs.
